How is child custody determined? What factors does a court take into consideration for custody decisions? Follow along as local family law attorney, Byron Barnett, discusses how child custody is determined in Texas.

How is custody determined?

Child custody decisions are made based on the best interest of the child. The court takes into account several factors to make this important decision. This includes the child's age, their physical and emotional needs, and each parent's ability to meet those needs. The court also considers the child's relationship with each parent and their own preferences if they are old enough to express them.

Types of Custody

Child custody can be sole or joint. Sole custody means one parent has primary custody while joint custody allows both parents to share more responsibility. The legal process involves filing a custody suit, attending court hearings and presenting evidence to support your case.
